SPEAKER: Before I call upon Shri Bhogendra Jha to move the motion for con 598 Emploment Guarantee Bill by Shri Bhogendra Jha sideration of the Bill, we have to fix the time limit for discussion on this Bill. Will it be two hours? SOVERAL HON. MEMBERS: Yes. MR. SPEAKER: Now, Shri Bhogendra Jha may move. 1756 hrs. SHRI BHOGENDRA JHA (Madhubani):Sir, I beg to move: "That the Bill to provide for employment or for means and resources for self-employment to all adult citizens of the country, be taken into consideration". Sir, we have been crying against unemployment and every one without any exception has been desiring that jobs be guaranteed to all. There have been movements outside and effort inside the Parliament also to made it a Fundamental Right. Throughout the world there has been a struggle for this. But, Sir, recently, in some parts of the world employment had been guaranteed to every one, both in theory and practice. This system has developed some cracks and I do also apprehend that unemployment also may begin in those countries. In such a situation, I think this Bill which I have moved is not a wishful thinking, it is not only the expression of a desire, but it is to guarantee employment to all the citizens of this country who want to do some jobs. Sir, this is the fourth Parliament when this Bill had been introduced. It was introduced in the Fourth Lok Sabha, in the Seventh Lok Sabha, in the Ninth Lok Sabha and again in this Lok Sabha. That way it is the fourth time that this Bill was introduced and I do submit, through you, to all my Hon. Members of this House that they do study this problem. The question of employment has two aspects, two sides. One side is that those who are able to do some jobs, willing to do some jobs, are not getting the jobs and they ----------------------------------------------------------------------SHRI BHOGENDRA JHA: I am coming to that point also. In Uttar Pradesh, there was no option except to invoke Article 356 and later on it was invoked in three more States. It was unprecedented and was for the first time in the History of Indian democracy that thrice the wrong affidavits were filed before the Supreme Court and false assurances were given in the capacity of the Leader of the opposition Party.PROF. PREM DHUMAL: No affidavit was filed on behalf of the Leader of the Party.SHRI BHOGENDRA JHA: It was filed on behalf of the Leader of the Party?PROF. PREM DHUMAL: No affidavit was filed even on behalf of the leader of the party.SHRI BHOGENDRA JHA: It was stated710 Stat. Resolutions re. approval of Proclamations in relation to U.P., M.P., H.P. and Rajasthanin the House by the leader of the party and reiterated time and again outside the House in the capacity of the leader of the party that no damage will be done to the structure. The group was being led by the President of the Bhartiya Janata Party and the leader of the position besides many others. In this task they were totally failed thereby inflicting a blot on the history of India.Mr. Speaker, Sir, I do not consider it proper to think of the structure as just the Mosque because our history is the testimony to the fact that in the whole world only in India since ancient times we had been safeguarding even the grave irritants. They might have got destroyed but we have not demolished them. In the circumstances the happenings of Ayodhya are a blot on the Indian history and have definitely caused deep anguish and pain to every Indian, including me, whether he is a Muslim or a Hindu.These People did not come forward when the Bhartiya Janata Party was indulging in mischievous propaganda, for years, to propagate that the disputed structure is also a temple. Because 14 pillars are of the temple only. So. where was the need to demolish it and thereby pull down curtains on an important chapter of the Indian history. This is only the handwork of an organised group of people. And out of the 5 banned organisations the chief Minister of the State claims to be a member of one of them and the other Chief Minister has also made a similar claim. I could have taken their assertions in right spirit had they claimed that they are the members of the banned R.S.S.oganisation. But now since it has been banned they are now not keeping any association with it. However they have never made such an assertion. The house had convened after the presidential address of the joint session of parliament to pay tributes to deceased members, including former president R. Venkataraman, Chaudhari Ranbir Singh, the lone surviving member of the Constituent Assembly of India and the father of Haryana Chief Minister Bhupinder Singh Hooda, and Periasamy Thiagarajan, who represented Sivaganga constituency in Tamil Nadu during 1977-79.The house adjourned for the day after the obituary references by Speaker Somnath Chatterjee on Thursday."It is not a miss. We know that the two great leaders (Balanandan and Jha) have died during this period. But we did not receive the official confirmation (about the demise) even after writing to the concerned district magistrates," said V.K. With the addition of Section 18A, it seeks to regulate export of goods on lease, hire or any arrangement. By Section 73A, it empowers the Reserve Bank of India to levy penalty on authorised dealers for convetion of RBI directions or for failure to file the prescribed return. These are the provisions. These changes have been made. What also can I call it? I would like to describe it that this is a liberaliscation on external front. This is an object surrender to the conditionalities of the International Monetary Fund. When he moved it, the Minister argued that with these changes, they hope the foreign investment will come to our country. He also said: 'we hope that we shall receive foreign techniques and we will get the foreign technical know how in our country. We hope the industries will be devoloped; problems in the employment front will be solved to a certain extent." These are all day-dreams.Sir, what is the condition of the country and what is the condition outside? Who will come here? What for will they come here?For what market will they come here? In our country, true to the class spirit of the ruling class, they have developed a market of people consisting around 10-15 crores. The market is very large in relation to the market of Australia or elsewhrer. Are we interested in the development of only a section of people in our country? Do we mean that development of these people means the development of the country as a whole? what about the vulenerable sections of the society? What about those who live below the poverty-fine? What about those youth who are seeking employment? What about those youth who have become frustrated, who could be assets to our country? We speak of human resource and human resource development. Yes, there are fine human beings. They have the ability; they have the genius.But our Government is not doing anything to make the human beings as human resources. Of course, there is the human failure. You have liberalised the433 Stat. Res. Disapprovalof the FER (Amendment)economy. You have changed the Industrial Policy. Every day, you tell us that so many offers have come. But, what is the actual position?How many of them have come, how much foreign investment has actually come and were is it? Is it in our basic industry and has it been spent for the infrastructural development of our country? No, it has not been spent on a singale project Do you believe that they, from outside, will make you self-sufficent and leave the market? If you believe that, you are living in a fool's paradise. if you go on producing such bills, I must say with all humility that you are digging the grave of our country. It shall be treated as the funeral Bill of our economy by the People of India. So, we cannot allow the pasage of the Bill.Sir, those foreign countries about whom the Minister and Members from the treasury Benches are speaking, they are in a recession.There is no order there. people there are becoming unemployed; the banks have failed and they want market. So, they want other countries to open their banks for their investment. have you not gone through the papers about the banking, seam or the securities scam? But if one is adment that he will not learn anything, then what is left to the lot of the country, is anybody's guess. He shall not wake up. We are opposed to this economic colonisation.So, the hopes with which this Bill has been prepared and the hopes that the Minister conveyed to us just a few minutesOrdinance FER 434(Amendment) Billago, are all false hopes. Investment from foreign countries is not coming. If it is coming, it is in this food processing industry. It is on those consumer goods, which the average people of our India do not want. And it is in those fields where investment is very little but the profit is very high. That is the way, history teaches us, that the empires once came with their colonies,Side by side, I Would request the Minister, through yo, to look into the provisions of the Dunkel Draft, to look into the provisions that are there in the TRIMs and TRIPs. If we look at it, in this manner that MRTP has been abolished, now FERAs Act is being amended for the benefit of the people living outside India, there that FERA Act has been amended to stop capital flight from our country but to encorage capital flight. There are the provisions of the TRIMs. If ail these three are taken together and given a thought, then we shall see that there is nothing left of the Indian economy. So please, for heaven's sake, look into all these problems. Please do not throw the lot of the people, do no., throw the lot of our contry to the whimsies and caprices of the International Monetary Fund and the World Bank.The nation will not forgive and the people will come to the streets They will raise their voice of protext. Here, by umeri cal strength, you may partly win, but that will be etrimental to he interests of the people, i will be detrimental to the interests of the country. We have already suggested the alternative way. I would reqest the government in this connection, to again have a look into it. We have our natural resources; we have our people who are ready to wrok we have the necessary technical know-how So, you may depend or these things ant raise the purchasing power of the people. a vast internal market is there, it is for you to explore; and you do not hink of it You are interested in the consmption market of 1 crores of people. But I am talking of market of 90 crores of people. You raise thier pruchasing power. On the basis of the consumption, build up the consmer good435 Stat. Res. Disapprovalof the FER (Amendment)[Prof. Susanta Chakraborty]inustry; on the basis of the pyramiddic structure of small and tiny industries, build up the large scale indstries; and neutralise the price level and stop the capital flight that is the way to self- reliant growth.Sir, we are unfortunate that the day to- day account is not available with us. I spoke on it that from 1984 to 1989, more than 21.1 million dollar has gone out from India. The capital from our country goes abroad. It is put therein the Swiss Bank and comes back to our country and used for the scandals like Bofors and others. That is or loss. To prevent this, we must do something. So, I oppose the Bill, tooth and nail. I want the government not to make it, a prestige issue. The country's prestige and the country's honour is more than that of you people, so, to save the country, please withdraw the Bill and do, at least, a little duty to the people which you are not used to. Since independence, they have not done any of their duties that they should have done to the people, for the sake of the country. Now, at least, wake up to the situation; after the aftermath of the ayodhya arises, your minorirty Government has come out with this ordinance. I do not know why. You waited for ten months. You dithered away the time. Now, you have come and that too in a hasty manner. Please do not try to pass this Bill with your numerical strength consider it again, withdraw it; take he opinion of the people and save the country. Thank you, Sir.[Translation]SHRI BHOGENDRA JHA (Madhubani): Mr. Chairman, sir, I had also given a notice or disapporval of the ordinance. I am glad nat Shri Lodhaji and other hon. Members have spoken in support of it. Rarely there is financaial matter on which the opposition unanimous. this is one such matter.Mr. Chairman, Sir, for me it is a matter of anguish because I had made a significant contribution to the FERA Act in 1973 when Ordinance FER 436(Amendment) BillI was the member of Lok sabha. This Bill is not an amendment to the parent Act but it is contrary to its intentions. The main objective of the Act was to streamline the flow of foreign exchange in the country. Now provisions like siphoning off of foreign currency or creating other bottlenecks are being aded. All India Radio and Doordarshan are crying hoarse over the changes in the world. We know that there are changes. When the former President of america Shri Bush went to Japan to seek support for American goods in that country, he got unconscious at a official function held in his honour .... ( Inlerrupotions) subsequently, the Amewrican people disloged him. Our hon. Prime Minister is imitating the style. He made a slip at one place when he said that Mr. Yeltsin is the first person who made Russia democratic. But that person has acquired all the power We are a developing country and inspite of our shortcomings we are producing each and every thing indigenoulsy. Today we have progressed becase we pursued certain basic policies after Independence. This Bill was introduced at the time of Bank nationalisation and when the Privy purses were abolished. At that time the Prime Minister was expelled by the ruling Congress Party. But today we are trying to go against the spirit of the Bill. What are we inviting? We are trying to promote exports so that we can increase imports. Are we being trapped in a vicious circle? It is true we are backwrd in the matter of technology and scientific development. we do not have adequate resorces. We want that foreign investment must flow. We would welcome investment by Non-resident Indians. We would not object if they take back the profits. But the danger is that we are not able to catch hold of the smugglers. Some of my friends rightly pointed out that it is an assalt on our free policy. Recent bomb blasts in Bombay is just an example of the havoc caused by the smugglers money. It is a great threat to not only our financail position but to political stablity also. We have crossed all limits. By giving such conces- sions, we cannot reform smugglers we should curb the parallel economy wich is run by these smgglers. Now we are again giving437 Stat. Res. Dlsapprovalof the FER (Amentment)concessions to black marketers. An order has been passed that there is no ban on bringing gold in the country anymore. No enquires would be made in this regard. Yesterday we passed a Bill and now there, will be no ban on brining any amount of foreign crrency into the country.It has been reported in the Newspapers that Russia is asking for Dollers from america and American President has expressed the desire that Mr. Yeltsin should continue. There is foreign interference even in such a country which was one of the most powerful till some time back. I think by following a correct policy, we can still evade to possible threat there. I would like to forewarn that this Bill has sounded the death knell. The entire clause is being removed.[English]'To remove restrictions on the transfer of any security from a register in India to a register outside India.'[Translation]The transfer would be done to any register anywhere in the world.There is no ceiling. The amount could be in millions or crores. Has the hon. Minister gone through the implications? Has the Cabinet delibrated upon it. Has the responsible officers prudently pondereed over it or has it been done under pressure or on orders from elsewhere? I do not know the implications but there are provisions through which the property from here would be directly transferred in foreign hands. I cannot even believe that such a Bill can be presented in the House, what to talk of its passing. I have not said anything of my own, I have just given quotations. There should be a provision that if somebody works here, for example, am expert in any field, for him, there should be no restriction on transfer of money.He can be pinvited for his expertise which we luck. But if there is no restruction of transfer of foreign exchange it would be a great assault on our economic independence. The Congress party has history of bunglings and irregularities. That is whyOrdinance FER 438(Amendment) Billpeople like us became communists in 1938-40. today when we are making tall claims about the Independence of the country, development and strengthening all the fileds of economy, is it not a slur on the face of Parliament that at the same time we are introducing such a black law? Today is the martydrom day of great men like Bhagat Singh, Rajguru and Sukhdev. I think it is a big assault on Parliament itself. If we read in between the lines of these provious we would come to know about the role of RBI and the Financial Department. I don't think that the multinational companies would set up consumer industries here. I am speaking from experience. We went to China recently where I enquired officially and otherwise also whether indsutries have been set up in 'Shanghai free trade zone' or Beigjing area but we fond that not even a single heavy industry has been set up by any foreign company.I don't feel that they will set up in future also. The Britishers did not set up during thier 200 year regime. The textile indstry flourished on 'Charkha'. With the use of charakha an atmosphere of hatred was created against foreign cloths. It also worked as an advertisement for this purpose. When they were asked whether they had set up any heavy industry, they replied thay they bad set up a Bank. What happened to production? They have done it in a limited area, and not in this manner. They are giving them complete freedom. They are ignoring the rule of the law in the country. That is why I say that it is a very dangerous Bill. I would reqest them if they have given word to anyone for this or mortgaged their minds somewhere, even then they should at least circulte it to elicit public opinion. Do not make haste and do not make this terrible mistake. As the hon. Minister said, there were some lacunaea at the time of passing this gill. From 1973 to 1993 this law helped us in standing on our own legs. It also halped us in earning foreign exchange and achieving financial independence. Therefore, it should be improved and no mistake should be made. It was done in the C.R.P. from 1898 to 1973. I do not mind439 Slat. Res. Disapprovalof the FER (Amendment)[Sh. Bhogendra Jha]for these changes but I oppose it as they are heading towards a dangerous directionMr. Chairman, Sir, it is a matter of happiness that the whole opposition is united on this issue. I Would request my hon. friends of the Congress Party that, they should join hands with the opposition in the national interest in opposing this Bill. If it is not possible to stop this Bill, you should disapprove this Bill and tell the government that the country is uppermost and Parliament is supreme.With these words I conclude,[English]SHRI P.G. NARAYANAN (Gobichettipalayam): Sir, the government has promulgated the Ordinance amending the provision of Foreign exchange Reglation Act (FERA) 1973 with a view of creating more conducive climate for attracting foreign direct investment, increasing production and promoting exports. In terms of the Ordinance, nine sections have been deleted, 19 sections have been amended and two sections have been added. The Ordinance, which has the force of law, has multifaceted dimensions and needs careful scrutiny.Now, with the introduction of many amendments in the Bill, including removal of many restrictions inclded in many sections of the act as well as omitting of many sections of the Act, the Indian industries particularly the medium scale and small scale industries would become defunct because they cannot face fierce competition by big industries and the goods produced by the foreign companies.Sir, I would like to briefly touch various implications of some important amendments. Clasue 5 seeks to remove restrictions on the import and export of gold, silver, jewellery and precious stones under Section 13 of the act.By omitting section 13 of the Act, it is notOrdinance FER 440(Amendment) Billknown whether the intention of the government is to prevent smuggling of these precious metals into the country.Sir, instead of taking other stringent measures to prevant smuggling of gold and silver into the country, removing restrictions under Section 13 of the Act would help smugglers to sell them in the open market. Perhaps the intention of the Government is to increase the quantum of gold and silver in the country in whatever manner possible, because of the closure of some gold mines in the country.Clause 14 seeks to omit Section 27 of the Act which provides for restrictions on persons resident in India associating themselves with or participating in concerns outside India. With the removal of restructions. under Section 27 of the Act, it would mean allowing or giving full freedom to the citizens of the country to indulge in activities inimical to the country's economic progress.Sir, I strongly feel that there should be some kind of control over the residents in India to supervise their activities.Clause 17 seeks to amend Section 30 of the Act. Its purpose is to remove restrictions on a foreign national taking up any employment in India in case where such national desires to acquire foreign exchange out of monies received by him in India. By removing the restrictions on a foreign national, it would mean flight of foreign exchange. This would enable the foreign national to remit the earnings to his relatives in foreign countries. Sir, only in those cases where sophisticated technology is involved for which foreign experts are necessary, the Government should permit remittances by them. But in all other cases restrictions should continue.Inclusion of Maithili hailed24 Dec 2003, 0224 hrs IST, TNNPrintEmailDiscussShareSaveCommentText:PATNA: The amendment in the Constitution to include Maithili language along with Santhali, Bodo and Dogri languages in the Eighth Schedule of theConstitution as approved by the Lok Sabha on Monday has been acclaimed by different organisations, litterateurs and political leaders. Welcoming the inclusion of Maithili language in the Eighth Schedule, Akhil Bharatiya Magahi Sahitya Sammelan general secretary Harindra Vidyarthi requested the Union government to include Magahi and Bhojpuri too in it, saying that these two languages fulfil all the requisite conditions. Thanking Prime Minister Vajpayee and deputy prime minister Advani for the decision, former chief minister Jagannath Mishra said during the laying of the foundation stone of a mega railway bridge over the Kosi river at Nirmali in June, the PM had announced that Maithili would be included in the Eighth Schedule. During the inauguration of the broadcast of a news bulletin in Maithili from the Darbhanga station of AIR on August 16, even Advani had stated that the PM’s announcement regarding Maithili would be implemented soon. The Karpoori Thakur government and the Jagannath Mishra government had recommended to the Union government in 1977 and 1980 respectively for the inclusion of Maithili in the Eighth Schedule. Chetna Samiti president Vijay Kumar Mishra, MLA, also congratulated Union minister C P Thakur and expressed the hope that now in the light of the Patna High Court order Maithili language would be included in the competitive examinations of the Bihar Public Service Commission. Samiti secretary Ganesh Shankar Kharga said 4.5 crore Maithili-speaking people of the Mithila region feel obliged to the Union government. State NCP general secretary Nitish Mishra said the inclusion of Maithili in the Eighth Schedule is the outcome of a long-drawn struggle of the Maithili-speaking people. At a seminar organised in the Maithili department of Patna University, head of the department Veena Karna said with the decision, a golden era of Maithili has begun. RJD MLA and former Bihar minister Shankar Prasad Tekriwal also thanked the PM for the decision. At a meeting held under the auspices of Maithili magazine Samay-Saal, litterateurs expressed their joy over the decision. The Maithili drama group Aripan and British Lingua managing director Birbal Jha also hailed the decision. C S Jha Azad adds from Madhubani: The inclusion of Maithili in the Schedule has caused ripples of happiness across the length and breadth of Mithilanchal also. Maithili has been included in the Eighth Schedule of the constitution along with Bodo and Santhali languages. With this, a long-cherished dream of over three crore Maithili-speaking people has finally been fulfilled. For a change, there has been no dichotomy in a politician's promise and performance. Prime Minister Atal Bihari Vajpayee has honoured the promise he made recently at Nirmali while laying the foundation of a rail-cum-road bridge over river Kosi. Thankfully, he has proved the sceptics wrong and won the heart of millions. This sense of triumph among the Maithili-speaking people of the state has a special significance. Coming to power in the wake of the Mandal Commission tornado in the '90s, the present RJD supremo and the then chief minister, Laloo Prasad Yadav, gave a body blow to the cause of Maithili by excluding it from the syllabi of the primary education and the BPSC examination, for which decisions were taken by former CM Jagannath Mishra's cabinet, along with the historic step of making Urdu the second official language of the state in the '80s. Yadav's bias against the language, which he, inadvertently, as it were, identified with the particular caste of Maithili Brahmins, remained so strong that even after the high court ordered Maithili's restoration as an optional subject in the BPSC examination, his government went in appeal to Supreme Court against this order. The stagnant social and political mood of Mithilanchal has suddenly turned euphoric after this decision. "It is a decision well-taken considering the long-cherished desire of Maithili-speaking people and Atalji deserves thanks for respecting the sentiments of crores of Maithils," said Bhawesh Chandra Jha, president of L N Mithila University Teachers Association. Kuldhari Singh and Daman Kumar Jha, both of Maithili department of J N College, said that though delayed, the decision remedies the injustice done to Maithili so far. "The intention of reaping political harvest by this decision notwithstanding, the move is a welcome step," said Kumarji Jha, district president of the NCP. At an emergent meeting of its members under the chairmanship of Satish Chandra Mishra, chairman, zila parishad, the Mithila Lalit Shodh Sansthan expressed happiness on the inclusion of Maithili in the Eighth Schedule of the Constitution and thanked the Union government for this. Prominent among those who attended the meeting included Bachha Thakur (retd. IAS), Jaya Dhari Singh and Padma Kant Mishra. The demand for Maithili's inclusion in the Eighth Schedule was first made in the late '50s. Prominent individuals who struggled for the cause of Maithili under different banners in their own way included the late Janaki Nandan Singh, the late Lakshman Jha, the late Pt Hari Nath Mishra, the late L N Mishra, ex-MP Bhogendra Jha, Jagannath Mishra, Pt Tara Kant Jha, Prof Baidya Nath Chaudhary 'Baiju'. Be as it may, it remains a fact that despite its genuine claim and people's desire for the same, non-inclusion of Maithili in the Eighth Schedule so far had failed to precipitate a situation which could snowball into a mass agitation. Though people suffered, they only simmered inwardly. Reasons for this, apparently, are too many to be enumerated here. Vanshmani Jha of village Barha . He was born on 9th August 1922. He was schooled in middle school Benipatti & GMSS High School Madhubani from where he passed the matriculation examination in first division in1941. He was admitted in mithila College Darbhanga in I.A. Bestowed with keen intellect & presence of mind from his very childhood he turned into a versatile genius. He left the institutional Studies during the “Quit India Movement” forever but remained voraciously studious till the end of life. By dint of self studies he acquired pedantic knowledge of the Vedas, the Ramayan, the Mahabharat, Upanishads, Puranas, Koran, Bible, the Indian philosophy and Marxist philosophy & so many schools of education.He represented the Jaynagar/ Madhubani constituency of the fourth, fifth, seventh, ninth& tenth Lok Sabha and spent a significant twenty years in Lok Sabha from 1967 to 1996 and spoke on almost all vital National and International issues effectively.He combined Quit India movement (against the party line) with people’s war with a self created slogan – Ham Apani Azadi Lenge Larna Hai Japan Se. Apani Raksha Desh Ki Raksha Aap karenge Shan Se. He demolished zamindari and feudal remnants without shedding a drop of blood of any landlord despite the fact that during land movement in Madhubani districts over six dozen of beloved leader like Com Paltu Yadav, Santu Mahto and other several workers of the party were martyred by the police and gunda collaboration of zamindar.He adopted the idea of non-violence with the high philosophy of “Hatya Nahi, Kranti Vijayee Ho, Sab Jangan Ka Ho Kalyan. Are Krantikari ! O Yogi ! ‘Krantiyog’ Ka Mangal Gan.The distribution of land among the toiling masses and homestead parchas to over three and half lakhs of homeless people is a glorious record of success of the land struggle launched by the CPI under the leadership of Com B Jha.His latest and highest ambition of life was the construction of ‘High Dams’ on rivers Koshi and Kamla respectively at Barah Kshetra and Shishapani as the “Permanent Solution” against devastation of floods & droughts and power crisis of Bihar. It is worth mentioning that by dint of Com B Jha’s herculean efforts the agreement between His Majesty Govt. of Nepal and the Govt. of India was completed and the operationalisation of the same is well-pending out of seven offices, four have been constructed in Nepal whereas rest three have to be constructed in Bihar for which both the previous and present Govt. have adopted the strategy of turning a deaf ear to it and having special interest in spending crores and crores of rupees in flood relief funds.Now when Com Bhogendra Jha is no more, his followers, admirers, the toiling masses and people in general, political parties and mass organizations pledged for the development and betterment of Bihar have to move forward and shoulder the responsibility.
